10

Consumer rights (B2C)

RoboCorpus primarily serves business clients (B2B). However, some of our products and services may be purchased by individual consumers (consumenten / consommateurs) within the meaning of Art. I.1, 2° WER. If you are a consumer, the following mandatory protections apply.

Your consumer rights are always protected

Nothing in these Terms affects your mandatory rights under Belgian consumer protection law (Book VI WER) and EU consumer law directives. Where any provision of these Terms conflicts with mandatory consumer law, that provision does not apply to you as a consumer.

Right of withdrawal

Under Art. VI.47 WER, consumers who enter into a distance contract (e.g. via this website or by email) for goods or services have the right to withdraw from the contract without giving any reason within 14 calendar days from:

  • The day of delivery, for contracts for goods;
  • The day the contract is concluded, for contracts for services.

To exercise the right of withdrawal, contact us at info@robocorpus.be with an unambiguous statement of your decision to withdraw. You may use the model withdrawal form published by the Belgian Federal Public Service Economy (economie.fgov.be), but this is not mandatory.

Exceptions to the right of withdrawal (Art. VI.53 WER): The right of withdrawal does not apply to, among others:

  • Service contracts where performance has begun with your express prior consent and confirmation that you lose the right;
  • Goods made to your specifications or clearly personalised;
  • Contracts for the installation of robot systems where work has begun at your request.

Online Dispute Resolution (ODR)

If you are a consumer with an unresolved complaint, you may submit it via the European Commission's ODR platform:

ec.europa.eu/consumers/odr

We are not obliged to participate in ADR proceedings, but will consider requests in good faith. Our email address for ODR purposes is info@robocorpus.be.

Legal guarantee

Purchases of goods by consumers are subject to the mandatory 2-year legal guarantee under Art. 1649bis of the Belgian Civil Code (as amended to implement EU Directive 2019/771). Complaints about defects must be reported within 2 months of discovery.

11

Governing law & jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) are governed by and construed in accordance with Belgian law, without regard to its conflict of laws rules.

B2B disputes: Any dispute between RoboCorpus and a business client that cannot be settled amicably shall be submitted exclusively to the competent courts of the judicial district where RoboCorpus has its registered office, unless mandatory law provides otherwise.

B2C disputes: For consumers, the courts of the consumer's domicile in Belgium, or the courts of the place of performance of the service, have jurisdiction, in accordance with Art. 624 of the Belgian Judicial Code and EU Regulation 1215/2012 (Brussels I bis). Consumers in other EU Member States may also rely on the courts of their own country under applicable EU rules.

In the event of a dispute, we encourage you to contact us first at info@robocorpus.be so that we can attempt to resolve the matter amicably before legal proceedings are initiated.
